Abortion Rights Ballot Measures Face Legal Challenges

(TheConservativeTimes.org) – Abortion rights ballot measures in Nebraska and Missouri are facing legal challenges as they approach looming certification deadlines.

Christopher Limbaugh, a Missouri Judge, has ruled against an abortion rights ballot measure in the state and agreed with a lawsuit stating that the “petition violated state law by failing to provide voters with a list of Missouri laws that would be repealed, directly or by implication.”

The measure says that the right to abortion is in the state’s constitution which would prohibit any government interference related to an abortion. Many organizers behind the ballot in Missouri are hoping to appeal Limbaigh’s decision at the state Supreme Court to stop the injunction.

Rachel Sweet, campaign manager for Missourians for Constitutional Freedom, said, “The court’s decision to block Amendment Three from appearing on the ballot is a profound injustice to the initiative petition process and undermines the rights of the three hundred and eighty Missourians who signed our petition demanding a voice on this critical issue.”

As of now, abortion is illegal in Missouri with the exception of the life and health of the mother. One measure would provide a right to an abortion until fetal viability, but they are facing legal challenges whether it meets the single-subject requirement.

A ballot measure could prohibit abortion in the second and third trimester “except when a woman seeks an abortion necessitated by a medical emergency or when the pregnancy results from sexual assault or incest.”

Abortion has become a political issue that’s taken on a lot of criticism since the overturn of Roe v Wade and will serve as a deciding factor for many this upcoming election.
