Widower Settles with Restaurants Associated with Wife’s Death

(TheConservativeTimes.org) – Two South Carolina bars that were accused of overserving a woman who slammed into a golf cart carrying a newly married couple away from their reception and killing the bride, have reached a tentative settlement agreement with the widower, the Associated Press reported.

On April 28, Jamie Lee Komoroski slammed her Toyota Camry into the golf cart, killing 34-year-old Samantha Miller and wounding three others, including her newly-wed husband Aric Hutchinson, who suffered multiple broken bones and a brain injury.

According to a petition for approval filed on September 28 in Charleston County Court, two of the bars named in the lawsuit, the Crab Shack and the Drop In Bar & Deli, agreed to settle the case for an undisclosed amount that Hutchinson’s attorney Daniel Dalton called “reasonable.”

The settlement agreement is confidential.

Meanwhile, the case against the other defendants will continue.

In a wrongful death lawsuit, Hutchinson alleges that Komoroski “slurred and staggered” through several Folly Beach bars before getting behind the wheel of her Camry with a blood-alcohol level of over three times the legal limit

According to the lawsuit, Snapper Jacks and El Gallo, along with the Crab Shack and the Drop In Bar & Deli, either allowed Komoroski to get drunk or continued to sell her drinks after she was already too drunk.

Komoroski’s employer, Taco Boy, which is also named in the lawsuit, is accused of recklessness and negligence. According to the complaint, an unnamed supervisor allegedly coerced Komoroski into drinking “a dangerous amount of alcohol” while attending an employee function on the night of the crash.

Taco Boy maintains that the function was not a work-related event.

According to Folly Beach police, Komoroski told a responding officer that she had one beer and a tequila drink about an hour before the crash. She allegedly refused a field sobriety test and “became uncooperative on scene,” the police affidavit said.

A state grand jury indicted Komoroski on September 12 for felony DUI resulting in death, two counts of felony DUI resulting in great bodily injury, and reckless homicide.
