Would SCOTUS Uphold Trump’s Indictment? His Lawyers Don’t Think So

(TheConservativeTimes.org) – Christina Bobb, an attorney for former President Donald Trump, believes that the special counsel indictment of Trump for conspiracy to defraud the United States, obstruct Congress, and hinder the right to vote would not hold up in the Supreme Court (SCOTUS). In Eric Bolling The Balance, she argued that the crux of Trump’s defense is political speech, which is constitutionally protected, adding that his claims about the 2020 election are not fraud and slamming the indictment as “schizophrenic.”

Bobb assessed that Special Counsel Jack Smith has the burden placed upon him to prove what Trump knew regarding the 2020 election if he is to prove that Trump attempted to defraud and obstruct.

She continued asserted the indictment is a form of election interference and political persecution against Trump, a message that even some fellow 2024 Republican presidential candidates share. Entrepreneur and 2024 presidential contender Vivek Ramaswamy defended Trump against the indictment he believes is un-American, saying that the Democratic party is actively using the Department of Justice (DOJ) as a police force against political opposition. Fellow contender and Florida Gov. Ron DeSantis believes that Trump shouldn’t face charges but asserts that focusing on the 2020 election distracts from defeating President Biden in the 2024 election.

However, while Trump’s allies were quick to defend him, Republican critics have made political attacks. Former New Jersey Gov. Chris Christie believes that Trump sent people to obstruct the January 6th proceedings and believes Trump deserves the indictment for his actions. And former Vice President Mike Pence condemned Trump, claiming he wanted Pence to violate the Constitution on January 6th.

The nature of the indictment, while primarily a legal issue, sets up a highly politicized debate between candidates in the Republican party. Despite the prosecution against Trump, he continues to dominate the Republican presidential primary and faces the best head-to-head polling against President Biden. As the election continues, Trump will continue to fight against the charges pressed against him, and his legal team is confident that its case based on political speech could lead to a not guilty ruling.
